You must be 21 or older to place a sports bet online or at a retail window in New York. That's older than the 18-plus minimum for the New York Lottery and horse racing. Governor Hochul has been explicit: preventing under-21 gambling is a stated policy goal, and the NYSGC proposed biometric confirmation for all wagers in 2026.

Do You Have to Be in New York State to Bet?

Yes. Every licensed operator uses geolocation technology to confirm you're physically inside state borders before accepting a wager. Out-of-state visitors who are 21+ can bet while they're here. New York residents who drive to New Jersey to get better odds still owe New York income tax on those winnings — crossing the border doesn't change your tax obligation.
